Terms of Service

1. The Service

MarketIQ provides relationship intelligence tools — prospect discovery, pipeline management, outreach drafting, and AI-generated summaries — for individual users. We are in private beta. Features may change, be added, or be removed at any time.

Certain features may be identified as beta, preview, early access, or experimental. Such features may be incomplete, less reliable, changed, suspended, or discontinued at any time and are provided without any additional warranty, support commitment, or service-level obligation.

2. Eligibility & Acceptable Use

MarketIQ is not directed to children or minors. You must be at least 18 years old to create an account, purchase a subscription, or use the Service. We do not knowingly collect personal information from anyone under 18. If we learn that someone under 18 has provided personal information to MarketIQ, we will take reasonable steps to delete it.

You agree to use MarketIQ only for lawful purposes. You may not:

• Scrape, harvest, or redistribute data from MarketIQ at scale.
• Use the platform to send unsolicited bulk email (spam).
• Attempt to access other users' data or circumvent security controls.
• Use discovered contact information to harass, threaten, or deceive people.
• Violate any applicable law, including CAN-SPAM, GDPR, or CCPA.

3. Outreach Responsibility

MarketIQ helps you draft outreach and manage relationships — it does not send messages on your behalf unless you explicitly trigger sending. You are solely responsible for every message you send, including compliance with applicable anti-spam laws in your jurisdiction.

MarketIQ does not guarantee any response rate, interview, offer, or outcome from outreach conducted using the platform.

4. AI-Generated Content

MarketIQ uses AI to generate intelligence briefs, email drafts, and signal summaries. These are aids, not authoritative facts. AI-generated content can be inaccurate, incomplete, or outdated.

You are responsible for reviewing all AI-generated content before acting on it, sending it, or relying on it. We make no warranties about the accuracy or fitness for purpose of AI-generated content.

MarketIQ's content, recommendations, and AI features are provided for informational purposes only and do not constitute legal, financial, tax, immigration, employment, career, recruiting, or other professional advice. You are responsible for evaluating all information and should consult a qualified professional where appropriate.

You may use AI-generated content produced for you through the Service for your own lawful purposes, subject to these Terms. MarketIQ does not represent that AI-generated content is unique, copyrightable, accurate, or free from third-party rights.

5. Subscriptions & Billing

Paid plans are billed on a recurring basis (monthly or annually) via Stripe. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.

You can cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not issue refunds for partial billing periods except where required by law.

We reserve the right to change pricing with reasonable advance notice.

6. Your Data

You own the prospect data, notes, and content you create in MarketIQ. We store it on your behalf for as long as your account remains open, because persistent access to your recruiting history is a core feature of the Service. If you delete your account, we delete or de-identify your personal data within a reasonable operational period, subject to the retention exceptions described in our Privacy Policy (including limited legal, security, fraud-prevention, and backup-related retention). 7. Termination

We may suspend, restrict, or terminate your account if you violate these terms, if your use creates legal or reputational risk, or where reasonably necessary to: protect MarketIQ, our users, or third parties; investigate fraud, abuse, or security incidents; comply with applicable law or valid legal process; comply with requirements imposed by Google, Microsoft, Stripe, or another integration provider; or respond to a provider's suspension, restriction, or discontinuation of an integration. We'll give notice where reasonably possible, but we may act without prior notice where urgent action is reasonably required. You can close your account at any time by emailing us.

8. Disclaimer of Warranties

MarketIQ is provided "as is" without warranty of any kind. We don't guarantee the service will be uninterrupted or error-free, or that prospect data discovered through the platform will be accurate or up to date.

Except as expressly set forth in a separate written service level agreement signed by MarketIQ, we do not guarantee any specific uptime, availability, or response time for the Service.

9. Limitation of Liability

To the maximum extent permitted by law, MarketIQ's total liability for any claim is limited to the greater of (a) $100, or (b) the total amount you paid MarketIQ in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages — including lost revenue, lost opportunities, or outcomes from outreach conducted using the platform.

10. Changes to These Terms

We may update these terms from time to time. We'll note the date above and, for material changes, notify you by email in advance. Continued use of MarketIQ after changes constitutes acceptance.

12. LinkedIn Extension

MarketIQ offers an optional Chrome Extension that assists with LinkedIn outreach preparation. By installing and using the extension you agree to the following:

• Not affiliated with LinkedIn. MarketIQ is not endorsed by, affiliated with, or sponsored by LinkedIn Corporation. LinkedIn is a registered trademark of LinkedIn Corporation.
• Your responsibility. You are solely responsible for ensuring your use of the extension complies with LinkedIn's User Agreement, Professional Community Policies, and any applicable laws. MarketIQ makes no representation that use of this extension is permitted under LinkedIn's terms.
• Authorization. By installing the extension, you authorize it to read the LinkedIn profile pages you navigate to and to insert AI-generated draft text into LinkedIn's message compose fields on your behalf — solely to facilitate outreach preparation.
• No auto-send. The extension never automatically sends messages, connection requests, or follow button clicks. All sends and connection decisions require explicit manual action by you.
• No guarantees. We do not guarantee delivery of any message or connection request, nor that use of the extension is safe for your LinkedIn account. Account actions taken on LinkedIn remain solely your responsibility.

You may disconnect or uninstall the extension at any time through Chrome's extension manager.
